On Thursday, the 36-year-old battery charger Wasiu Afolayan and the 34-year-old spare parts trader Kola Adeyemi were found guilty by the court presided over by Justice Ayo Oyebiyi.
A five-count conspiracy charge was filed against them at the court. The charges included: "Armed Robbery contrary to and punishable under section 1(1) and (2) (a) of the Robbery and Firearms (Special Provisions) Act, Cap R.11, Laws of Federation of Nigeria, 2004;" "Contrary to Sections 6(b) and punishable under 1(1) of the Robbery and Firearms (Special Provisions) Act, Cap R.11, Laws of Federation of Nigeria, 2004;
"Attempt to Rob with Weapons" in violation of and subject to punishment under the Robbery and Firearms (Special Provisions) Act, Cap. R.11, Laws of the Federation of Nigeria, 2004; and
"Murder contrary to and punishable under sections 324, 316, and 319 (1) of the Criminal Code, Cap 34, Vol. II, Laws of the Osun State, 2002, and Unlawful Possession of Arms contrary to and punishable under section 3(1) of the Robbery and Firearms (Special Provisions) Act, Cap R.11, Laws of Federation of Nigeria, 2004."
They entered a not guilty plea to the charges that were brought against them.
Barrister Bewaji Adeniji, the Ministry of Justice's prosecuting attorney, informed the court that Wasiu Afolayan and Kola Adeyemi laid siege on December 7, 2018, at a location close to C.A.C. No. 16 in Oke-Onitea Area, Osogbo.
Adeshina Olaniyan, the suspects' attorney, had previously implored the court to balance leniency with justice because his clients were first-time offenders.
